Terms of Service
Last updated: 19 October 2026
In short
- byer is a private network for licensed real estate agencies in Portugal and the people who work for them. We are not a party to any deal and do not carry out real estate mediation.
- Publish a buyer demand only for a real client who agreed to it, and never identify the buyer in what other members see.
- Contact details are shared only after the buyer's agency accepts an introduction request. Use them only for that introduction and the deal it may lead to.
- AI helps write buyer demands and can get things wrong, so read each one before you publish it. byer is currently free, and Portuguese law applies.

Who we are and what byer is
byer is provided by LX Launch, Lda. (NIPC 518742024), Rua Nova do Til, 17-A, 9050-052 Funchal, Portugal (“we”), on www.byer.pt and in the byer app. It is for professionals, not consumers. A buyer who receives a link from their agent is not bound by these terms: the privacy policy covers them.
byer is a private network where licensed agencies share what their buyers are looking for without saying who they are. A buyer's agent publishes a buyer demand; a member with a property that may fit, usually a listing agent, sends an introduction request; the buyer's agency accepts or declines. byer is a tool, not a real estate agency. We do not carry out mediation or act for buyers or sellers, take no part in negotiations, viewings or deals, handle no money, take no commission and are not a party to agreements between members.
These terms are a contract between us and each member agency, and between us and each person who uses byer for one (“you”). Your agency accepts them when applying, and each person when joining; your agency answers for what its members do on byer. We keep a record of the version accepted. byer is currently free, and we charge nothing without your agency's agreement. Apple and Google are not parties to these terms.
Joining and your account
- byer is only for real estate mediation businesses with a valid AMI licence from IMPIC, and for the people who work for them. A person at byer checks each licence on the IMPIC register. No one is admitted automatically, and we may refuse without giving reasons.
- An invitation, from us or from a buyer's agent of your agency, can be used once within 14 days. Anyone with an invitation link can join your agency, so send it only to the colleague it is for.
- When you join, you confirm that you work for that licensed agency and that the licence is valid. Tell us at once if it changes or lapses, or if you leave the agency.
- Each account is for one person: do not share it. Protect your password and your email, lock your phone, and tell us at once if you think someone has used your account.
- Buyer's agents create and manage the agency's demands, send buyer links and invite colleagues; listing agents use the network, send and answer introduction requests and write messages. Every member sees all of the agency's demands, including the private part, and its introductions and conversations, so invite only people your agency trusts with its clients' data.
- Tell us when someone leaves your agency, and which colleague takes over their demands.
Buyer demands and buyer links
- A buyer demand is what one buyer is looking for, and it belongs to the agency that creates it. Its shared part, seen by all members, holds the area (never an address), budget, type, size, rooms, timeframe and features, a short line about the buyer, notes on what matters to them, and the agency and agent who posted it. Its private part, with your client's name, contact details and notes, is seen only by your agency.
- Nothing goes on the network until someone in your agency publishes it. A published demand stays for 90 days from creation or the last confirmation: confirm it to keep it live. Deleting a demand is final, including the introductions and conversations about it, for both agencies.
- A buyer link lets your client describe the home they want, typed or spoken, and comes back to your agency as a draft. You send it yourself, so send it only to your client, and write to us at once if it reaches the wrong person. It stays open for 7 days, and your agency can create up to 50 a day. Before you send one, tell your client who receives their answers, that AI reads them, and what other agencies will see.
- Demands marked “Demo” are examples and do not represent real buyers.
Introductions and messages
- Only agencies whose registration we have checked can send introduction requests. The buyer's agency sees who is asking, their message and our checks, and any of its members can accept or decline. The answer is final: after a decline, the agency cannot ask again about that demand.
- Contact details move only after a yes, when each agency receives the other agent's email and phone. byer never reveals who the buyer is.
- A yes opens one conversation between the two agencies. Messages cannot be edited or deleted once sent, and deleting the demand deletes the conversation for both agencies, so keep your own record.
- Email notices never contain the message text, and you can turn them off in your profile.
Your client's data
Your client's data comes into byer through you, and your agency answers for it. On its behalf, you must:
- publish a demand only for a real client who asked you to find a property and agreed that you share their search on byer without saying who they are;
- have a legal basis under the GDPR, and tell your client how byer uses their data before you publish or send a link;
- keep the shared part free of anything that identifies your client, and leave out health, religion, ethnic origin and other special categories of data: write the need (“step-free access”), not the reason;
- keep each demand accurate, pause it when your client stops looking, and delete it when your agency no longer needs it;
- keep your agency's own records for its legal duties, such as identifying clients and preventing money laundering (Law No. 83/2017), and the written mediation contract (Law No. 15/2013).
Your agency is the controller of its client files (each demand's private part, and what is typed or said while preparing it), and byer its processor, as set out in How we handle your client files. For the shared part of a published demand, your agency and byer are joint controllers: your agency decides to publish and informs its client, and byer runs the network and is the buyers' contact point. Whichever of us receives a buyer's request acts on it and tells the other within 5 working days, and byer notifies the CNPD of any breach affecting the shared part where required. Each agency is a separate controller of the contact details and messages it receives through an introduction.
Rules of use
Use byer only for your real estate work, in good faith. Do not:
- publish a false or out-of-date demand, or one your client did not agree to;
- identify a buyer in the shared part, try to find out who another agency's client is, or contact that client behind their agency's back;
- use what you learn on byer, including contact details, for anything other than the introduction and the deal it may lead to, or share it outside your agency beyond what your own client needs to know;
- publish anything illegal, discriminatory, offensive or misleading;
- scrape or resell the network, share your account or links, use a false licence or pretend to be someone else;
- probe or get around byer's security. If you find a flaw, tell us and do not exploit it.
We do not tolerate objectionable content or abusive behaviour. You can block another agency from one of its demands, requests or conversations: neither of you then sees the other's demands or can ask for an introduction, and the other agency is not told. Any member of your agency can lift the block in their profile.
Your content
What you put on byer stays yours or your agency's: buyer demands belong to the agency, your profile and photo to you. You give us a free, non-exclusive licence to store, adapt, process and show it only as far as needed to run byer, ending when it is deleted (except for what other members have already received, such as messages). You confirm that you have the right to share it. The byer software, design and brand belong to us.
AI-written text
AI, run on Microsoft's Azure OpenAI, writes the questions, pulls the details from what is typed or said, turns speech into text, and writes the short line about the buyer and the notes on what matters. It can miss, misread or add a detail, so read every demand before you publish it: you are responsible for it as if you had written it.
Once a demand is saved, you can change its notes, budget, timeframe, minimum bedrooms and minimum size. Members who have seen it are shown that it changed, and agencies with a request waiting or a conversation open on it are emailed. For anything else, write to us, or delete the demand and write it again.
The AI is told to leave out anything that identifies the buyer, and byer discards text that contains your client's name, but take out identifying or sensitive details yourself before you publish. We do not use your content or your clients' data to train AI.
What our checks cover
Before an account opens, a person at byer checks on the IMPIC register that the member's AMI licence is active and belongs to their agency; members see the result as “Checked” or “Not checked”. The register lists businesses, not their staff, so we rely on each member's declaration that they work for the agency. We do not monitor the register afterwards, or check what a demand says, such as the buyer's budget or funds. Make your own checks before you rely on another member.
Reports and moderation
Members can report a demand, a request or a message from the screen where they see it. Anyone else can report illegal content to contacto@byer.pt, saying why it is illegal and where it is, with their name and email and a statement that the report is accurate and made in good faith. A person reviews every report, and we tell the reporter what we decided. We inform the authorities of anything suggesting a crime that threatens someone's life or safety.
We do not monitor everything members publish. Under the Digital Services Act, we are not liable for illegal content we do not know of, and act quickly once we do. We may ask for a correction, remove content, or suspend or end a membership, and we email the member what we did and for how long, the facts, the rule involved, whether an automated tool was used and how to contest it. Our only automated tool discards AI text that contains the buyer's name.
To contest a decision, write to us within six months, and a person reviews it again, normally within 30 days. You can also go to court, or complain to ANACOM, Portugal's Digital Services Coordinator.
Availability and liability
We work to keep byer available and secure, but cannot promise that it will always work without interruptions, and we may change or remove features.
- We are liable without limit for harm caused by intent or gross negligence, for harm to life, physical or moral integrity or health, for non-contractual damage to property, and wherever the law does not allow a limit.
- Otherwise, we are not liable for loss of profit, such as lost commissions or deals, or other indirect loss, and our total liability to an agency in any 12 months is limited to what it paid us in that period or 500 euros, whichever is higher.
- We are not responsible for what members publish or do, for agreements between agencies, or for deals that happen or do not.
If someone makes a claim against us because a member of your agency broke these terms or the law, your agency compensates us for the harm and the reasonable costs.
Closing accounts
You can delete your account at any time under Profile, then Delete account, and your agency can leave by writing to contacto@byer.pt. We may suspend an account or an agency, or end a membership, at once if a licence lapses or cannot be confirmed, after serious or repeated breaches, for a serious security risk or when the law requires it, and otherwise with 30 days' notice, telling you why unless the law prevents it.
A departing member's demands and messages stay with the agency. When an agency leaves, its demands leave the network at once and are deleted, with their conversations, 30 days later; it can ask for a copy before then. The rules on client data and confidentiality still apply afterwards.
Changes to these terms
For a significant change, or one that reduces your rights or adds to your duties, we email every member at least 30 days ahead and ask them to accept it, and your agency can leave at no cost before it applies. Corrections and other changes apply when we publish them. The date at the top shows the current version, and you can ask us for an earlier one.
How we handle your client files
As your agency's processor, byer handles its client files, meaning what it holds about its clients and the people they mention (names, contact details, notes, and what is typed or said), while your agency is a member and only so that it can record its clients' searches and prepare them for publishing, including with AI. byer:
- acts only on your agency's documented instructions (these terms and its choices in byer), and says so if an instruction seems unlawful;
- never uses the files for its own purposes or to train AI, opens them only when your agency asks or the law requires it, and binds its staff to confidentiality;
- protects the files with appropriate security measures, and tells your agency without undue delay of a breach affecting them;
- uses only these sub-processors, which your agency authorises by accepting these terms: Supabase, Vercel, Microsoft (Azure OpenAI), Resend and Google (our mailbox), under the same duties and the GDPR's transfer safeguards. We give 30 days' notice of any change, and your agency can leave at no cost if it objects;
- helps your agency answer its clients' requests and meet its duties on security, breaches, impact assessments and consulting the CNPD;
- deletes the files when your agency leaves, after offering a copy, unless the law requires otherwise, and gives your agency the information and audits it needs to check all this.
Law and contact
- These terms are governed by Portuguese law. Where the law lets the parties choose the court, the Lisbon courts have jurisdiction.
- The Portuguese version prevails over the English one. If a clause is invalid, the rest still applies.
- Write to contacto@byer.pt, in Portuguese or English, about anything in these terms; a person reads every message. This is also our single point of contact under the Digital Services Act, for members, other users and the authorities. By post: LX Launch, Lda., Rua Nova do Til, 17-A, 9050-052 Funchal, Portugal.
